Consideration of the question as to teh authority competent to impose teh penalities of dismissal /removal on classIII staff officioating in class I or II id the dicilienary action is proposed to be taken for offences by him while in classI or II service --Decision taht the rule embodied in clause 1 of article 311 of the constitution refers to the penalty and not to the offence when an employe is sought to be dismissed he is a class III employe it is the appointing authority of class III officer who is competent to awaard the penalty.
