Question raised by the F.P.S.C. (i) under the rule or executive instructions a punishing authority places a Govt. servant under suspension as a priliminary measure to the holding of a regular departmental enquiry against him (ii) whether the power to grant to a Govt. servant whose suspension is held to have been unjustifiable or not wholly justifiable, full pay and allowance or a portion thereof, which has been conferred by F.R. 54 of the revising or appellate authority, is exercisable by the original punishing authority, and (iii) whether conversion of the periof of suspension into leave under Govt. of India's decision (1 below F.R. is not ultra virse to the provisions of F.R. 55 which lays down that leave may not be granted to a Govt. servant under suspension
