Ruling of Mr. Justice Blude in the case of Des Raj, an accused in the Lahore conspiracy case, versus the crown, that a Court of Land can question the existence of an emergency for which an ordinance has been from undertaken. Question of amending section 72 of the government of India Act, 1919, so as to make it clear that in exercise of the power to make ordinances, the decision of the Governor General as to the existence of a State of emergency, shall be final.
