Interpretation of the second proviso to Fundamental Rule 30(1). Discussion as to whether the officer next above the officer in whose favour a eclaration is to be made under the proviso must have acting promotion even though he is voluntarily preparedto sacrifice it for reasons personel to himself. Case of Mr. B.A. Bambawala, I.C.S. in the Central Provinces. Question whetherit is open to the Governor to make or not to make the eclaration under F.R. declaring the post to be outside the regular line under the said proviso, even though it may happen to be within the orinary cadre.
