Decision that leave not due’ under note 2(ii) to fundamental rule 78 can be granted in the ordinary course to an I.C.S. officer or a military commissioned officers preparatory to retirement and the amount of leave not due which such an officer can take preparatory retirement should strictly be limited to the amount which may be granted to him under the rule mentioned without involving debit to his leave account case of Mr. E.H. Berthoud, C.I.E., O.B.E., F.C.S., a commissioner in Bihar and Orissa.
