Policy to be adopted in the matter of payment of full pay and allowance for the period of absence of an employees, who obtains a declaratory decree from the court of law declaring his removal orders as nulland void. Decision that Board's instructions in No. E52RG6-6 dated 27.3.1953 continues to apply in such cases in the individual case of Shri Someshwar Banerjee Bridge Inspector, E. Railway, it was decided as under: (1) He is legally entitled to full pay and allowance for three years backwards from date of filing of suit of arrears of pay and allowances i.e. 30.4.54. (2) Full pay and allowance from 30.4.51 to date of reinstatement i.e. 29.3.52 (date of reinstatement) (3) Shri Banerjee to be paid full pay and allowances from 13.6.50 (date on which first suit for declaratory decree was decided by High Court on grounds of equity
