Western Railway Proposal from the to amend section 10(3) of the Factories Act, 1948 for allowing the State Governments to appoint Medical Officers in the employment of Railways to act as Certifying Surgeons. Railway Administration advised that any Medical Officer employed by a factory is disqualified to be a certifying surgeon, whether he is interested in the factory or not, but that the Railway doctors attached to a hospital or a dispensary, not in any way connected with the factory, and working elsewhere can in no sense be said to be in the employment of the factory and there is, therefore, no bar under section 10(3) of the Factories Act, 1948 theirs being appointed as certifying surgeons
