Western Railway Payment of overtime allowance and daily allowance to staff governed by the Factories Act, while working outside the factories limits-Instructions issued to Railways --- Decision that (1) Para 460(5) -W which stipulates that workmen sent out from shops with engines and vehicles on trial trips should be paid for the actual number of hours worked beyond shop hours, should be taken as illustrative and not as exhaustive. Any staff sent out from the the workshop on duty with engines or vehicles on trial trips and others sent on duty as, for instance, for attending to cash safes etc. In such cases, overtime allowance at Single rate should be allowed for work done beyond their normal shop hours. (2) Since daily allowance and overtime allowance are given for different sets of conditions, both these types of payment should be made provided the conditions prescribed are satisfied in each case. (3) For purposes of overtime, only the actual hours of duty beyond the shop hour need be taken into account. however in cases where it is not possible to find out the exact period of the duty hours beyond the shop hours during which the staff actually work, the overtime should be calculated on the basic of the total period during which they remain on duty beyond shop hours
