Appeal preferred by Messrs. Killick, Nixon & Co., Agents, Kohinoor Mills Company, Limited, Bombay, against the refusal of the Commissioner of Income Tax, Bombay, to grant a refund of Income tax claimed by the Company under section 33 of the Income Tax Act, 1886. Decision that, as under the Income Tax Act, 1886, the Government of India have no locus standi in matters relating to assessment, it is not within their competence to issue rulings in respect of matters on which the law is found to be obscure or unsatisfactory.
