Consideration of the question whether in a case where the name of an employee is kept on the panel for promotion to a higher grade and the orders of his promotion on the basis of his position on the panel, are also issued but the employee cannot carry out the orders due to his personal difficulties, it would be in order to remove his without giving him any show-cause notice or this would amount to 'withholding of promotion' which is a penalty under the Discipline and Appeals Rules. Ministries of Home Affairs and Law advised that this would not amount to the imposition of the penalty of 'withholding of promotion'
