Western Railway: Question for examination whether Muccadams and Khalasis in stores depots who are detailed to do the work of loading and unloading of wago is in the Yards of the workshops and who have to be sometimes employed after he normal hours of work should be treated as factory workers. The W.Rly were advised that the criterion for deciding whether an employee was covered by the term worker in the Factories Act was whether the work done by him had a direct relationship to the manufacturing process carried on in a factory. The more important factor was the work done by each employee rather than the category to which he belonged. The matter was one that should be settled between the officer-in-charge of the establishment and the Chief inspector of Factories of the State. The Railway were asked to examine in case further and settle the case in consultation with the chief inspector of factories concerned
