Central Railway: Question whether certain categories of casual labourers viz Khalasi/Peons/Watchmen/Messengers/Flagmen engaged under the Executive Engineer, Special Works, Kurla were covered by the N.W.Act, 1948. The Ministry of Law advised that the question whether the employee was governed by the M.W.Act in each case had to be examined in the Light of the work done by the worker and the employment. If the employee is employed in a schedule employment or in any process or branch of work forming part of such employment he would get the benefit of that Act
