Decision. Subject of other condition being satisfied withdrawals may be permitted for acquiring on ownership basis a flat in a building in cities like Bombay even through the Ist and the land on which it is built do not become the property of the Rly servant concerned provided that the Rly Servant produces within 3 months of the receipt of the amount a proof to the effect that. (a) he has made payment for the flat (b) he has become a member of the limited company, society or any other incorporated body (recognised in law) formed by the purchasers of the flats in the building and. (c) The builder has transferred the legal title to the building to the said company society or incorporated body, in rule no. 1323(1)(h)(v)
