Question how to regularise the period of suspension of staff who are suspended as a precursor to departmental action which is initiated which is initiated with the issue of charge-Sheet and, who, in the meanwhile, before findings are recorded departmentally, are prosecuted on the same charges, acquitted by the court and are suspsequently taken back to duty without any further departmental action being taken against them. Decision:- that when an employee is acquitted on benefit of doubt, he cannot be regarded or, in the case of suspension, that it was wholly unjustified, and that in such cases Rule 2044(3)-R.II. comes into play. From date of acquittal, however, full pay and allowances and treating as duty is obligatory
