Western Railway: Compensation to Shri. Lala Nanda, Points man, for the severe injury he sustained on 11.10.1971, when a flying nail struck his left eye during application fire practice by 1037 Railway Oply Coy personnel (T.A. personnel) performing range classification. In carrying out range classification, is it possible for railway personnel who are also members of the Territorial Army to be considered embodied under the definition given in the Army Act 1913. Conclusion: The employee is entitled to the disability payments allowed by the Indian Army Act of 1950 since the Army Act of 1950 protected railway workers who served in the Territorial Army while performing range classification. Therefore, the W.C. Act's provisions did not apply in this particular situation
