The proposal by North Eastern Railway to reclassify Dining Car staff as Excluded under the Hours of Employment Regulations has been referred to the Chief Commercial Supervisor. The Chief Commercial Supervisor, the FA, and the CAO have all been consulted in relation to this proposal. The Chief Commercial Supervisor has advised that the proposal regarding reclassification may be reexamined in light of the recommendations made in paragraph 432 (27)(3) of the Adjudicator's Awards, and the matter may only be referred to the Board if necessary going forward
