Southern Railway. Writ Petition No.156 of 61 in the High Court of Mysore at Bangalore- S.A. Bakeem, ex. PWI-vs-DEN/II/Hubli. Railway's proposal to file an appeal in the Supreme Court- Consideration of the question whether an authority which appointed a person in a lower grade can remove him from service while the employee is working in a higher grade even though that authority may not be competent to make appointments to that higher grade, without offending the provisions of Article 331(1) of the Constitution. Decision on the above question, in consultation with the Ministry of Law, was in the negative and an appeal in the Supreme Court was not, therefore, filed. Instructions were issued that the 'Appointing Authority' should be determined under Rules 1702(i)- R.I. and 1705- R.I. whichever is the highest authority
